Kupola Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Kupola’s website, applications, and related services, including the Kupola for Parents app and the Kupola Jr. app (collectively, the “Service”).

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

If you are a parent or legal guardian using the Service in connection with a child’s device or profile, you represent that you have the authority to do so and that you accept these Terms on behalf of yourself and, where applicable, the child account under your supervision.

1. Eligibility and Parent-Managed Use

Kupola is intended to be set up and managed by a parent or legal guardian.

You may use the Service only if:

  • you can form a binding agreement under applicable law;
  • you are authorized to use the device, account, phone number, email address, or payment method connected to the Service;
  • you are legally permitted to enable monitoring, parental control, family safety, or device-management features for the child device or account involved.

A child may not independently create a parent account.

2. Your Account

You are responsible for:

  • providing accurate account information;
  • maintaining the confidentiality of your login credentials;
  • restricting unauthorized access to your account;
  • ensuring that information connected to your family account remains accurate and up to date;
  • all activity that occurs under your account, except to the extent caused by our own failure to maintain reasonable security.

You must notify Kupola promptly if you believe your account has been accessed without authorization.

3. The Service

Kupola provides tools related to family safety, parental controls, online safety, alerts, activity reporting, location-based features, and related account management.

Depending on device type, operating system, permissions, platform limitations, and enabled settings, the Service may include:

  • SOS-related features;
  • attention mode, pause, or phone lock-related controls;
  • no-show alerts;
  • kid tracker or live location features;
  • location history;
  • places or geofence alerts;
  • internet filters and SafeSearch-related features;
  • app blocker and website blocker features;
  • daily limits and screen time schedules;
  • low-battery alerts;
  • tasks and brain challenge features;
  • app and phone usage reporting;
  • installed app list and app approval or rejection tools.

Certain features may not be available on all devices, operating systems, app versions, or jurisdictions, and some features may function differently depending on platform rules or technical limitations.

4. Permissions and Device Access

Some features require device permissions, background processing, notifications, location access, or other system-level access.

By enabling relevant features, you instruct Kupola to process the information and device signals needed to operate those features.

You are responsible for:

  • reviewing and approving permissions requested during setup or use;
  • ensuring that you are authorized to enable those permissions for the relevant device and child profile;
  • understanding that disabling permissions, battery settings, connectivity, operating-system access, or related device controls may limit or prevent certain features from functioning properly.

5. Acceptable Use

You agree not to:

  • use the Service in violation of applicable law, regulation, court order, or third-party rights;
  • use the Service for stalking, harassment, unauthorized surveillance, abuse, or any harmful or unlawful purpose;
  • impersonate another person or misrepresent your authority over a child, device, or account;
  • interfere with, disrupt, reverse engineer, or attempt to gain unauthorized access to the Service or related systems, except as permitted by applicable law;
  • upload, transmit, or distribute malicious code, harmful content, or material that interferes with the Service;
  • use the Service in a way that could damage, disable, overburden, or impair Kupola or its providers;
  • attempt to bypass feature limitations, security protections, or enforcement controls in a manner not authorized by Kupola.

Kupola may suspend or terminate access if we reasonably believe the Service is being used in violation of these Terms or applicable law.

6. Child Accounts and Parent Responsibility

Kupola is designed for parent-managed family use. If you connect a child device or create a child profile, you are responsible for:

  • ensuring that your use of the Service is lawful in your jurisdiction;
  • providing any notices, permissions, or consents required by law;
  • determining which features are appropriate for your family and child;
  • reviewing alerts, reports, and controls made available through the Service;
  • managing settings, permissions, and child-device configuration.

Kupola does not provide legal advice, parenting advice, law-enforcement services, or emergency-response services.

7. Location, Alerts, and Safety Features

Certain features use device signals, location data, schedules, connectivity, or system conditions to generate alerts or display information.

You understand and agree that:

  • alerts, incident information, and location-based features depend on device availability, permissions, power status, connectivity, operating system behavior, third-party services, and other factors outside Kupola’s control;
  • alerts may be delayed, unavailable, inaccurate, or incomplete in some circumstances;
  • the Service is intended to support family awareness and coordination, not to guarantee safety, supervision, or emergency response;
  • SOS and similar features do not replace emergency services, law enforcement, or medical assistance.

If there is an emergency, contact the appropriate emergency services directly.

8. Subscriptions, Billing, and Paid Features

Some parts of the Service may later be offered on a paid, subscription, or premium basis.

If Kupola introduces paid features, plans, or subscriptions:

  • pricing, billing terms, renewal terms, trial terms, and cancellation terms will be provided at the time of purchase or in a separate policy;
  • purchases made through an app store or third-party platform may be subject to that provider’s billing terms and policies;
  • refunds, where available, may be governed by a separate Refund Policy or by the applicable app store or payment provider rules.

Until such paid terms are introduced, nothing in these Terms guarantees that any feature will remain free of charge permanently.

9. Privacy and Data Handling

Your use of the Service is also governed by Kupola’s legal and privacy pages, including the Privacy Policy, Cookies Policy, GDPR & COPPA Compliance page, CCPA Privacy Notice, and Data Retention & Deletion Policy.

By using the Service, you acknowledge that Kupola may collect, use, and process information as described in those policies.

10. Account Deletion and Termination

You may request account deletion through the app.

If a deletion request is submitted:

  • a 7-day grace period begins;
  • the account remains accessible during that period;
  • the deletion request may be canceled before deletion is completed;
  • if not canceled, the account and linked data are deleted on the 7th day.

During the grace period, the Service continues to function normally. However, if a parent logs out during the grace period, the parent will not be able to sign in again without contacting support for account recovery assistance before deletion is completed.

Kupola may suspend, restrict, or terminate access to the Service if required to protect users, comply with law, prevent abuse, investigate suspected misconduct, or enforce these Terms.

11. Third-Party Services and Platforms

The Service may interact with third-party platforms, app stores, operating systems, maps, payment providers, messaging services, push-notification services, hosting providers, analytics providers, or advertising providers.

Kupola is not responsible for the availability, functionality, billing practices, or privacy practices of third-party services that are not controlled by Kupola.

Your use of third-party services may be subject to separate terms and policies.

12. Intellectual Property

The Service, including its software, design, branding, text, graphics, interfaces, and related content, is owned by or licensed to Kupola and is protected by applicable intellectual property laws.

Subject to these Terms, Kupola grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for its intended personal family-safety and parental-control purposes.

You may not copy, modify, distribute, sell, sublicense, or create derivative works from the Service or any part of it, except as permitted by law or by Kupola in writing.

13. Disclaimers

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KUPOLA DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR FULLY ACCURATE.

Kupola does not warrant that:

  • the Service will always be available;
  • any feature will work on every device or platform;
  • alerts, reports, or location information will always be accurate, complete, or timely;
  • the Service will prevent harm, misconduct, device misuse, or unsafe situations.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Kupola and its affiliates, licensors, service providers, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, or business opportunities, arising out of or related to the Service or these Terms.

To the maximum extent permitted by applicable law, Kupola’s total liability for any claim arising out of or related to the Service or these Terms will not exceed the amount you paid to Kupola for the Service during the 12 months before the event giving rise to the claim, or, if you paid nothing, a reasonable minimum amount permitted by law.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

15. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Kupola and its affiliates, officers, directors, employees, licensors, and service providers from and against claims, liabilities, damages, losses, and expenses arising out of or related to:

  • your use of the Service;
  • your violation of these Terms;
  • your misuse of child-device, monitoring, or family-safety features;
  • your violation of applicable law or the rights of another person.

16. Changes to the Service

Kupola may add, remove, suspend, modify, or discontinue features, functionality, or parts of the Service at any time.

We may also update technical requirements, supported devices, or feature availability based on product, legal, security, or operational needs.

17. Changes to These Terms

Kupola may update these Terms from time to time.

When we do, we will update the “Last Updated” date at the top of this page. Where appropriate, we may also provide notice through the Service or by other suitable means.

Your continued use of the Service after updated Terms become effective constitutes acceptance of the revised Terms, except where applicable law requires a different process.

18. Governing Law and Disputes

These Terms will be governed by the laws applicable in the jurisdiction determined by Kupola’s governing legal framework, except to the extent otherwise required by applicable consumer-protection law.

Any dispute, claim, or controversy arising out of or related to these Terms or the Service will be resolved in the courts or dispute forums determined by that governing legal framework, unless applicable law requires otherwise.
